MARGERET HEWITT 1859

This is the last will and testament of me MARGERET HEWITT of Maryport in the County of Cumberland,spinster,I give and bequeath unto my niece CATHEREINE MUCKLE my best feather bed,bolster and two pillows and my clothes and wearing apparel equally between my nieces the said CATHERINE MUCKLE and ELEANOR HEWITT,and as to the rest and remainder of my personal estate ,I direct my trustees hereinafter named to convert into money all such parts of my personal estate as shall not consist of money or invested in the government parliamentary The Docks trust of Liverpool or real securities.And all payments of my debts ,funeral and testamentary expenses to invest the ready money and the proceeds of my personnel estate upon real or government parliamentary ,the Dock Trust of Liverpool or ant security of ant company incorporated by act of parliament paying a dividend,And to pay one moiety of the income of my said personnel estate unto my sister MARY MITCHINSON during her life and all other moiety thereof unto my sister ELEANOR MELMORE during her life.And I direct at the death of either of them the income of her so dying shall accumulate and become part of my residuary personal estate.And at the death of survivor of them,I direct my said trustees to pay the following legacies and shares to nephew and nieces which I direct shall be considered vested at my decease except that I have given to HENRY MITCHINSON,which is not to be vested until the survivor of my said sisters,To my nieces CATHERINE MUCKLE one hundred pounds,TO JOHNSTON MELMORE and THOMAS ALDRIDGE MELOMORE thirty pounds each in consideration of the allowance made by them towards the support of their parents,To NORMAN MITCHINSON ten pounds,To MARGERET HODGSON ten pounds,To MARY STORR five pounds,To SARAH HUGHES five pounds,To each of my executors five pounds for their trouble,And as to the rest and remainder of my paid,personel estate,I give and bequeath unto the said CATHERINE MUCKLE,JOHNATHON MELMORE,THOMAS ASBRIDGE MELMORE,WILLIAM MELMORE,ELEANOR HEWITT,HENRY MITCHINSON and to the children of JOHN MITCHINSON who are to take their fathers share the said personal estate to be divided per shares and not per capita with respect to the children of the said JOHN MITCHINSON and the same,I direct to be paid to them not withstanding minority and whose receipts shall be of sufficient discharge to my said trustees,I give and devise all estate vested in me in trust or by way of mortgage to my said trustees and their heirs subject to the equitted effecting the same respectively,I appoint RELSICK WOOD of Liverpool,Gentleman, to be trustee and executor of this my last will and testament hereby revoking all other wills.

I MARGERET HEWITT of Maryport,Cumberland give and bequeath unto CATHERINE MUCKLE of Braithwaite my three best silk dresses and what clothes remain to be divided between ELEANOR HEWITT and MARGERET HODGSON ,and also my watch,chain and seals to the first above named CATHERINE MUCKLE of Braithwaite,and also the above named ELEANOR HEWITT,nine spoons,I also give my old family gold ring and also my small feather bed,bolster and pillows and also the two blankets and two quilts,and one white one,also one pair of sheets and the bed stocks,and also to MARGERET HODGSON,one pair of sheets,two blankets and two quilts,the picture in the parlour to be returned to JOHNSTONE MELMORE and what furniture remains to be sold ,and to MARY MELMORE the wife of JOHNSTONE MELMORE the sum of five pounds as a token of regard to her kindness to my sister,

This is a codicil to the last will and testament of me MARGERET HEWITT ofMaryport in the County of Cumberland,spinster,wheras by my last will and testament dated sometime in the year one thousand eight hundred and fifty seven.I have given and bequeathed a certain specific legacy and a certain interest or share in my residually personal estate to my nephew JOHNSON MELMORE who is since dead,now it is my mind and will that the child or children of the said JOHNSTONE MELMORE shall be substituted in his place and take the said legacy and share and the same shall not lapse but in all respect I republish and confirm my said will,

In witness whereof I have set my hand this sixth day of July one thousand eight hundred and fifty nine.

In her Majesty's Court of Probate,The District Registry of Carlisle,In the goods of MARGERET HEWITT deceased.

I MATHEW STORR of number two,Dewhurst Road,In the Parish of West Derby in the County of Lancaster,Gebtleman.Make oath that I am one of the subscribing witnesses to the first codicil to the last will and testament of the said MARGERET HEWITT late of Maryport in the County of Cumberland,spinster,the said codicil now hereunto annexed,bearing date fifteenth of October 1858 and that the said testatrix executed the said codicil on the day of the date threreof,by signing the name at the foot or end thereof as the same now appears thereof in. the presence of me and of ANN STORR the other subscribing witness thereto,both of us being present at the same time,and we thereupon attested and subscribed the said codicil in the presence of the testatrix.
